Terms of Use

1. Scope

These Terms govern your use of the foody iOS app and the website foodytheapp.com, operated by Silas Knapp (full details in the Legal Notice). foody is free of charge; nothing is sold through it.

Apple's Licensed Application End User License Agreement also applies to the app as distributed through the App Store. Where the two conflict, Apple's agreement prevails in respect of the software licence itself.

2. Minimum age

You must be at least 16 years old to create a foody account. By creating an account you confirm that you meet this requirement. foody is not directed at children. If I become aware that an account belongs to someone under 16, I will delete it together with all associated data.

3. Your account

Provide a valid email address that belongs to you, and keep your password confidential. You are responsible for activity carried out through your account; tell me at service@foodytheapp.com if you believe someone else has gained access to it.

You may delete your account at any time under Settings → Delete Account. Deletion is permanent and removes your account, recipes, meal plans and photos.

4. Your content

Recipes, ingredients, meal plans and photos you create remain yours. To operate the app I need a limited technical permission: the right to store, reproduce and display your content in order to provide the service to you. It is non-exclusive, unpaid, and ends when you delete the content or your account.

You are responsible for what you upload. Do not upload content that infringes third-party rights — including recipe texts or photographs copied from cookbooks or other people's publications — unlawful content, or photographs of other people without their agreement. Infringing content may be removed and, in serious or repeated cases, the account suspended or deleted; wherever reasonably possible I will contact you beforehand.

5. What foody is not

foody is an organisational tool. It is not nutritional, dietary or medical advice. No nutritional values, calorie counts or allergen information are calculated or verified, and ingredient names come from users without review.

If you have allergies, intolerances, a medical condition or specific dietary requirements, rely on the product packaging and on qualified professional advice — not on this app.

6. Availability

foody is provided free of charge and maintained in my spare time. No particular level of availability is guaranteed, features may change or be removed, and the service may be discontinued — in which case I will give notice in the app at least 30 days in advance wherever possible. Please keep your own copies of recipes that matter to you.

7. Liability

Liability without limitation. I am liable without limitation for damage caused intentionally or by gross negligence, for damage arising from injury to life, body or health, and where liability is mandatory under statute.

Liability for slight negligence. In cases of slight negligence I am liable only for breach of a material contractual obligation — an obligation whose fulfilment is essential to the purpose of the agreement and on which you may reasonably rely. In such cases liability is limited to foreseeable damage typical of this kind of agreement.

Otherwise excluded. Any liability beyond the above is excluded. This applies in particular to indirect damage, loss of profit, and loss of data, save where such loss results from a breach of the obligations set out above.

8. Acceptable use

Do not attempt to access other users' data, circumvent or probe the app's access controls, place an unreasonable load on the infrastructure through automated access, reverse engineer the app beyond what mandatory statute permits, or use foody to store or distribute unlawful content. Serious breaches may lead to suspension or deletion of the account.

9. Changes to these terms

These Terms may be amended. You will be informed of substantial changes in the app or by email at least 30 days before they take effect. If you do not accept them, you may delete your account; continued use afterwards constitutes acceptance.

10. Governing law and severability

German law applies. Where you are a consumer resident in another EU or EEA state, mandatory consumer protection provisions of your country of residence remain unaffected. If any provision is or becomes invalid, the remaining provisions are unaffected.
